Terms and Conditions

1. Provider and subject matter

These Terms and Conditions apply to the use of German4You at german4you.ch. The provider is Alpasana GmbH, UID CHE-168.266.327, Farbweg 18, 5745 Safenwil, Switzerland, contact sascha.fiechter@alpasana.ch.

German4You is an AI-supported German learning platform for levels A1 to C2. The platform supports learning, practice and exam preparation. German4You does not issue an official certificate and does not replace a recognised language examination.

2. Account and verification

Certain functions may require a user account. Users must provide accurate, current and complete information and keep their login credentials confidential. The provider may use appropriate verification and security measures and may block accounts in cases of misuse, false information or security risks.

3. Scope of services

Basic use is free of charge and includes a placement test and one static exercise per level. AI functions such as dynamic exercises, AI tips, explanations, chat coach, analyses, writing correction and file upload analysis are charged with German4You Credits.

AI feedback and assessments are learning aids. They may be incomplete or incorrect and do not guarantee any specific learning success, exam success or language level.

4. Prices, Credits and validity

German4You uses a pure Credit model. New users may receive voluntary welcome Credits if these are displayed in the offer. Additional Credits can be purchased through the packages offered, in particular packages for CHF 5, CHF 15 and CHF 40, as displayed in the checkout.

Prices are shown in CHF and include statutory value added tax where applicable. Purchased Credits are tied to the respective user account, are not transferable and cannot be paid out as a monetary amount. German4You may set a reasonable validity period for Credits if this is clearly displayed before purchase.

5. Payment via Stripe

Payments are processed through the payment service provider Stripe. German4You does not store complete credit card details. Stripe's terms and privacy information also apply to payment processing.

6. Welcome and voucher Credits

Welcome Credits, voucher Credits and other free Credits are voluntary benefits. They cannot be paid out, are not transferable and may be blocked or withdrawn in the event of misuse, multiple registrations, technical errors or breach of these Terms.

7. Reservation and re-crediting of Credits

Before a paid AI action, German4You may reserve the Credits expected to be required. Unused Credits are automatically re-credited. In the event of a technical error where no usable service is provided, no deduction is made or the reserved Credits are credited back.

8. Digital content, withdrawal and refunds

German4You provides digital content and digital services that can be used immediately after purchase. Users from the EU expressly agree during checkout that German4You may begin providing the service before any withdrawal period has expired. They confirm that any right of withdrawal for digital content already provided may thereby expire.

Credits already consumed are deemed used once the corresponding analysis, answer, exercise or assessment has been provided. Refunds for consumed Credits are excluded to the extent permitted by law. Statutory rights, in particular mandatory consumer rights and claims for defective performance, remain reserved.

Unused purchased Credits may be refunded as a goodwill gesture at the provider's discretion. Free Credits and voucher Credits are not paid out. In the event of verifiable technical errors, German4You will correct the Credit balance or refund the affected amount if no usable service was provided.

9. Rules of use and misuse

Users may use German4You only lawfully and in accordance with these Terms. In particular, circumventing access restrictions, automated mass use without consent, resale of Credits, misuse of vouchers, disruption of operations, uploading unlawful content and inputs that infringe third-party rights are prohibited.

For file uploads, no confidential, sensitive or unnecessary personal data may be uploaded. Names, addresses, dates of birth, ID numbers, faces of third parties, medical, official, legal, financial and other particularly sensitive information must be removed or redacted before upload.

10. Availability and maintenance

German4You endeavours to provide reliable availability but does not owe uninterrupted operation. Maintenance, updates, security measures, disruptions at third-party providers or force majeure may temporarily restrict access.

11. Liability

The provider is liable to the extent required by mandatory law. Otherwise, to the extent permitted by law, liability is limited to direct damage caused by intentional or grossly negligent conduct. Liability for indirect damage, consequential damage, data loss, loss of profit, failed examinations or decisions based on AI feedback is excluded to the extent permitted by law.

12. AI notice

German4You uses AI systems and technical service providers to create exercises, explanations, analyses and feedback. AI outputs may be incorrect, incomplete or misleading. Users should verify important content and consult a teacher, examination body or competent professional body for official questions.

13. Data protection

The processing of personal data is governed by German4You's Privacy Policy. It provides information in particular about AI processing, payments via Stripe, file uploads and data transfers to technical service providers.

14. Termination and account closure

Users may request deletion of their account at any time unless statutory retention obligations prevent this. The provider may block or terminate accounts in the event of serious or repeated breach of these Terms, misuse or security risks. Outstanding statutory claims remain reserved.

15. Changes to the Terms

German4You may amend these Terms if this is required due to product changes, legal requirements or security and operational reasons. Material changes will be communicated in an appropriate form. Credits already purchased will not be made worse retrospectively where mandatory law prevents this.

16. Applicable law and place of jurisdiction

Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent permitted by law, Safenwil or the competent court at the provider's registered office. Mandatory places of jurisdiction and mandatory consumer rights, in particular for consumers in the EU, remain reserved.

In case of discrepancies between translations, the German version is massgebend.
